1. Who we are
Alorah Foundation (“the Trust”, “we”, “us”) is a public charitable trust registered in Tamil Nadu, India (Reg No. 4/82/2026; PAN AAMTA4503G), approved under Section 80G (AAMTA4503GF20261) and registered under Section 12AB (AAMTA4503GE20261) of the Income-tax Act, 1961. The website alorah.org (“the Website”) is owned and operated by the Trust.
2. Acceptance of these terms
By accessing the Website or making a donation to the Trust, you agree to these Terms & Conditions, our Privacy Policy, and our Refund & Cancellation Policy. If you do not agree, please do not use the Website.
3. Donations
- All donations are voluntary contributions to the charitable objects of the Trust. Nothing on this Website is a sale of goods or services, and no goods or services are provided in exchange for a donation.
- Donations may be made by bank transfer (NEFT/IMPS/RTGS), UPI, cheque/DD, or any online payment method offered on the Website (including cards and net banking through our payment gateway partner, when available).
- Unless you direct a donation to a specific open project, donations are applied to the Trust’s general charitable fund. If a directed project becomes fully funded or cannot proceed, the Trust may apply the balance to a similar charitable purpose.
- Donations are acknowledged with an official receipt carrying a unique Donation ID after the payment is verified against our bank records.
4. 80G tax benefit and donor information
- Donations to the Trust are eligible for deduction under Section 80G of the Income-tax Act, 1961, subject to the limits and conditions of that Act.
- To issue your 80G receipt and to report donations in Form 10BD (and issue Form 10BE), we are required to collect your full name, PAN (or Aadhaar), and address. You are responsible for the accuracy of the details you provide; receipts are issued from the information you submit.
- Tax benefit depends on your own tax situation; please consult your tax advisor.
5. Foreign contributions (FCRA)
The Trust is not registered under the Foreign Contribution (Regulation) Act, 2010 (FCRA) and therefore accepts donations only from Indian citizens and Indian entities, from Indian bank accounts. By donating you confirm that your contribution is not a “foreign contribution” under FCRA. Any donation found to be a foreign contribution will be returned.
6. Use of the Website
- You agree not to misuse the Website, attempt unauthorised access, submit false information, or use it for any unlawful purpose.
- Content on the Website (text, photographs, the Alorah name and phoenix logo) belongs to the Trust or its licensors and may not be reproduced for commercial purposes without written permission.
- Project details, funding figures, and timelines are published in good faith and updated as work progresses.
7. Your personal data, and the DPDP Act, 2023
The Trust is a Data Fiduciary under the Digital Personal Data Protection Act, 2023, and the personal data of donors, applicants and volunteers is handled under that Act and under the Privacy Policy, which forms part of these terms.
- Notice and consent. Wherever the Website asks for personal data, it says first what is collected, what it is used for, how long it is kept and how consent may be withdrawn. Consent is asked for that stated purpose alone, and it is never bundled with anything else.
- Consent is never a price. Permission to publish a beneficiary’s name, photograph or story is asked for separately, only after a decision on their application, and refusing it changes nothing about the help they receive.
- Your rights. You may ask for a copy of the personal data the Trust holds about you, ask for it to be corrected or completed, ask for it to be erased, nominate somebody to exercise these rights if you cannot, and withdraw consent at any time. Write to alorahfoundation@gmail.com or telephone the number below; we answer within 15 days.
- What withdrawal does and does not do. On withdrawal the Trust stops using your data for that purpose and erases what it holds, except where a law requires it to be kept. 80G receipts, Form 10BD returns, donation records and the audit trail are kept for the periods the Income Tax Act and the Trust’s audit obligations require, and they cannot be erased on request.
- Children. Where a beneficiary is under 18, personal data is collected from a parent or guardian. The Trust does not use children’s data for tracking or for any form of advertising.
- Applicant documents. Identity documents, medical papers, fee bills and bank details sent with an application are stored on the Trust’s own server, are readable only by trustees, are never published in any form, and are never shown to a donor.
- Breach. If personal data held by the Trust is affected by a breach, the Trust will inform the people concerned and the Data Protection Board of India as the Act requires.
- Grievances. Raise any concern with the Managing Trustee using the contact details below. If it is not resolved to your satisfaction, you may complain to the Data Protection Board of India.
8. Limitation of liability
The Website is provided on an “as is” basis. To the maximum extent permitted by law, the Trust is not liable for any indirect or consequential loss arising from use of the Website, including interruptions, errors, or third-party payment systems. Nothing in these terms limits liability that cannot be limited under Indian law.
9. Governing law and jurisdiction
These terms are governed by the laws of India. Courts at Coimbatore, Tamil Nadu shall have exclusive jurisdiction over any dispute relating to the Website or donations made through it.
10. Changes to these terms
We may update these Terms & Conditions from time to time. The version published on this page, with its effective date, is the version in force. Questions about these terms can be sent to the contact below.
